I, Sam Howard, of Star Route, New Haven, in the county of Nelson, state of Kentucky, do hereby make this my last will and testament, hereby revoking any former will or wills, or any codicil or codicils thereto, that may heretofore been made by me.
First: -- I will and direct that my all just debts and funeral expenses be paid as soon as possible after my death.
Second: -- I will and direct that my executor hereafter named, shall spend the sum of thirty dollars, for masses to be said for repose of my soul.
Third: -- I will and bequeath to my beloved wife, Sudie Howard, for her own use and benefit, the sum of one thousand dollars.—two hundred dollars of which is to be paid her as soon as possible after my death, and the residue thereof is to be placed in the hand of a trustee, and shall be paid to her by such trustee in annual installments of two hundred dollars each, plus the accumulated interest thereon, until such fund shall be exhausted. The trustee is to be named by my executors who are hereinafter named.
Fourth: -- I also will and bequeath to my said wife, for and during her natural life only, the place on which I now reside, known as the property purchased from the Whelan heirs, and also the tract of land generally and commonly known from “Bull Run Tract”. All proceeds or income that may be derived from said land to be used by my said wife as in here judgement a she deems best.
Fifth: --All the remainder of my estate, real personal or mixed, and wherever located, shall converted into money, and then equally divided among all my children, share and share alike, but with following provisions: To my daughter, Cora Cecil, and my sons Arthur, Uriel, Carl , Linn and Raffo Howard, there shall be paid to them the sum of five hundred each, as soon as possible after my death, and the balance due these six named children shall be placed in a trust, and only the interest thereon, and one-tenth of the principal thereof shall be paid to them each year for the period of ten years, at the end of which time the trust fund will become exhausted. However, it is my intention, and I so will and direct that should any of these six named children be owing me anything at the time of my death, as may be represented by advancements to them by me, or notes which I may hold against them, such indebtedness must be liquidated, and the amounts they are to receive in cash, or the sums to be held in trust for them, shall be reduced by the amounts of their respective indebtedness to me. It is further provided, that should any or all of these six named children die before they have received the full portion of my estate due them, the amount still due and remaining unpaid shall go to the children whose funds are held in trust, must be paid over to their trustee, and paid out to them as herein set out. It shall be the duty of my executors hereinafter named, to designate the trustee who is to act for said six children.
Sixth: -- Should any of my other children, whose distributable portion of my estate is not specifically provided for in the above, or fifth clauses of my will be owing anything at the time of my death, as may represented by advancements to them by me, or notes I may hold against them such indebtedness must be liquidated before they are entitled to receive any portion of my estate. Such indebtedness, if any, may be adjusted by ducting same from the respective amounts due them, provided, of course, the amount of their inheritable portion is greater than the amount of their indebtedness.
Seventh: -- I hereby will and direct that my executors hereinafter named, or their successors, shall have full and complete power and authority to sell and convey at public auction. Any real estate I may die seized or possessed of, and wherever location, and make the purchaser or purchasers thereof, deed or deeds of General Warranty, and further, after the death of my wife, they shall also sell at public auction, the real estate conveyed to her for life, and the proceeds derived therefrom shall be equally divided among all my children in the same manner and under the same provisions as set out in the fifth and sixth clauses hereof.
Eight: -- In the event any of my children shall institute legal proceedings to break or set apart this will, or any part thereof, the one, or ones so instituting such proceedings shall disinherited and receive no part of my estate.
Ninth: -- I hereby nominate and appoint my sons, Ivo A. Howard and Fennesey Howard, as executor of this my last will and testament, and direct that they may be permitted to qualify as such without surety. And in the event either of them shall be dead at the time of my death, then my son Virgil Howard shall act as joint executors with one living. It is expressly understood, however, that my said executor are to receive the sum of one hundred dollars each , and are to be paid necessary and legal expenses in winding up the estate, but are to receive no further commission of any kind.
